Question: Can You Also Explain What Rising Blood Alcohol Levels are in Wisconsin?

Answer: Whenever we drink, it takes a while for alcohol to get absorbed into our blood stream. So what we'll see is oftentimes, and in most cases, alcohol will rise in level before it eliminates or goes out. We call that a bell curve. And everybody is going to rise and eliminate at different speeds. The issue is what you were at the time of driving. So, it's very possible that if you had a drink shortly before driving, that at the time you take your test, either at the hospital or at the police station, your test result is much higher than it would have been at the time of driving. And that is a possible defense in a lot of cases.
